SailorsDeck Online Shop Terms and Conditions

1. General provisions

These terms govern the use of the SailorsDeck online shop and purchases made through it.

The shop owner and seller is SailorsDeck OÜ, Metsatuka, Rohuküla, Haapsalu linn, Läänemaa, 90441, Estonia. Registry code: 16242538. VAT: EE102702206. Coop Pank account: EE894204278619839704.

By placing an order, the customer confirms having read and agreed to these terms.

2. Products

The online shop sells educational and playing cards related to seamanship, navigation, nature and safety, and related products. Product images are illustrative. Minor differences in colour, packaging or printing are not considered defects if they do not affect the product’s intended use.

3. Prices

All prices are in euros (€) and include VAT under Estonian law unless stated otherwise. Delivery charges are added and displayed before order confirmation. SailorsDeck OÜ may change prices; the price in force when an order is placed applies. In the event of an obvious pricing error, SailorsDeck OÜ may cancel the order and refund the amount paid.

4. Ordering and payment

An order is considered placed once confirmed and payment has been received. An order confirmation is emailed to the address supplied by the buyer.

SailorsDeck OÜ may cancel an order if a product cannot be delivered, is out of stock, the order contains an obvious error, or performance is prevented by force majeure. In that case, the payment is refunded as soon as possible and no later than 14 days.

5. Delivery

Orders are delivered to the address or parcel locker selected by the buyer. Delivery times depend on destination country, shipping method and carrier. SailorsDeck OÜ is not liable for delays caused by carriers, customs, force majeure or circumstances beyond its control. Risk of accidental loss or damage passes to the buyer upon delivery.

6. Withdrawal and returns

Consumers may return goods within 14 days of receipt. To withdraw, notify us by email and return the goods within 14 days of sending the withdrawal notice. Returned goods must be complete, undamaged and contain all supplied parts.

Removing factory packaging, including protective film or cellophane, means SailorsDeck cards are no longer considered unopened. If packaging is removed, parts are missing, or goods are damaged, dirty, worn or unsuitable for resale as new, SailorsDeck OÜ may reduce the refund proportionately to the diminished value.

The buyer pays direct return costs except for incorrect or defective goods. Refunds are made using the original payment method within 14 days after receipt of returned goods or proof of their return.

7. Complaints

The buyer may submit complaints concerning defects under applicable law. Report defects within a reasonable time after discovery and include a description and photographs where possible. SailorsDeck OÜ is not liable for defects caused by improper use, negligent handling, normal wear, mechanical damage, water, chemicals, heat or other external factors. Defective products will be repaired, replaced or refunded according to applicable law.

8. Intellectual property

Texts, designs, photographs, illustrations, logos, trademarks and other materials on SailorsDeck cards, the online shop and other materials belong to SailorsDeck OÜ or their respective rights holders. Copying, reproducing, distributing, publishing, translating or commercially using these materials without SailorsDeck OÜ’s prior written permission is prohibited.

9. Limitation of liability

SailorsDeck cards are educational and recreational learning aids. Although reasonable efforts are made to ensure accuracy, SailorsDeck OÜ does not guarantee completeness, accuracy, currency or suitability for a particular purpose. These cards are not official navigation materials and do not replace nautical charts, navigation equipment, regulations, legislation, training or professional advice. Users make decisions based on the information at their own risk.

To the extent permitted by law, SailorsDeck OÜ is not liable for damage, costs, injury, lost income or other direct or indirect consequences arising from use, misunderstanding, interpretation, inaccuracy, incompleteness or obsolescence of the information. Navigation and safety requirements may change; users must verify relevant information against official sources before acting.

10. Digital card packs and services

Purchasing a digital card pack grants the customer a personal, non-transferable right to use the purchased learning materials in supported SailorsDeck digital environments. It is a one-time purchase, not a subscription. Use may require an account, compatible device and internet connection. Copyright does not transfer to the customer.

The digital service may be interrupted or limited by maintenance, server or network outages, hosting failures, software errors, cyber incidents, data damage, backup restoration or human error. Beyond obligations imposed by law, SailorsDeck OÜ does not guarantee uninterrupted availability, error-free operation, complete preservation of learning statistics, or repair or restoration within a fixed period.

Restoring from a backup may be necessary, and recent learning progress or settings may be lost. Purchased access rights can be checked against available order and payment records. To the extent permitted by law, SailorsDeck OÜ is not liable for indirect or consequential damage due to outages or data loss, including failed examinations, time lost or lost income.

SailorsDeck is a learning tool, not an official examination platform. No particular exam result is guaranteed. SailorsDeck OÜ may modify or discontinue digital services in accordance with applicable law and existing contractual obligations. These terms do not promise an additional fixed period of use or indefinite provision of service.

Statutory withdrawal rights and exceptions apply to digital content and services. Where the law requires separate explicit prior consent, confirmation and notice before withdrawal rights can be lost, acceptance of these terms does not replace those steps. Nothing here restricts statutory consumer rights.

11. Personal data

SailorsDeck OÜ processes buyers’ personal data only to fulfil orders, deliver goods, communicate with customers and meet statutory obligations. Further details are provided in our privacy policy.

12. Force majeure

SailorsDeck OÜ is not liable for failure to perform obligations caused by force majeure, including natural disasters, war, strikes, communications or power outages, acts of authorities or other unforeseeable events.

13. Dispute resolution

These terms are governed by the laws of the Republic of Estonia. Disputes will first be addressed through negotiation. If no agreement is reached, consumers may refer the matter to the Consumer Disputes Committee or a competent court.

14. Changes to terms

SailorsDeck OÜ may amend or supplement these terms. Changes are published in the online shop and take effect upon publication.
